3. Liability and Warranties

3.1 Service Warranties

We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. However, we make no guarantees regarding specific outcomes or results, as these depend on various factors including facility conditions, environmental circumstances, and client cooperation.

3.2 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN SERVICE AGREEMENTS, OUR SERVICES AND WEBSITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement or title
  • Warranties regarding the accuracy or completeness of information
  • Warranties that services will meet all client expectations

3.3 Limitation of Liability

  • The amount paid by the client for services in the three months immediately preceding the claim

3.4 Exclusion of Consequential Damages

IN NO EVENT SHALL CHANTRA PURE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3.5 Insurance and Indemnification

Chantra Pure maintains appropriate professional liability insurance. Clients agree to indemnify and hold harmless Chantra Pure from any claims, damages, or expenses arising from the client's breach of these terms, negligence, or willful misconduct.

4. Intellectual Property Rights

4.1 Ownership

All intellectual property rights in our website, branding, service methodologies, and proprietary processes remain the exclusive property of Chantra Pure. No transfer of ownership occurs through the use of our services.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for its intended purposes. This license does not permit reproduction, redistribution, or commercial use of our content without explicit written permission.

7. Dispute Resolution

In the event of any dispute, controversy, or claim arising from these Terms and Conditions, the parties agree to first attempt to resolve the matter through good-faith negotiations and informal discussion.

7.2 Mediation

The remaining provisions shall continue in full force and effect.
